These terms govern use of PracticeXP. Where a school or district has signed a separate license agreement or Data Privacy Agreement with us, that agreement controls wherever it conflicts with these terms.
PracticeXP is web-based software for tracking student practice in school music programs. It records practice time that students report themselves. It does not verify that practice occurred, and must not be relied on as proof of attendance or participation.
Accounts belong to a school's music program. A school purchases a license; its directors and students then use the service under that license. Students access it because their school directed them to. Parents and guardians have no account and no login.
If your program grows beyond the student count in your plan during a term, nothing stops working and you are not charged automatically. We will show the director a notice, and you move to the larger plan at renewal.
You may cancel at any time from the billing portal in the app. Access continues to the end of the period you have already paid for.
Annual fees are not refundable on a pro-rata basis after a term begins. If the service is materially unavailable for a sustained period, or if a school is charged in error, contact us — we will make it right rather than hide behind this clause.
If a trial expires or a subscription is cancelled, the app becomes read-only: all existing practice history stays visible and exportable, but new practice cannot be logged until billing is resolved. We do not delete data as a consequence of non-payment.
A failed payment does not restrict anything. The director receives a notice asking them to update the payment method, and the service continues to work normally in the meantime.
The school owns its data. Directors can export the full practice record as a CSV at any time. Our handling of student data is described in the Privacy Policy and, for schools under contract, in the Data Privacy Agreement and retention policy.
Don't use the service to store data it isn't meant for (it is not a student information system, a health record, or a discipline record), attempt to access another school's data, interfere with its operation, or resell access. We may suspend an account that does.
Some features generate text using a third-party AI model. That output can be inaccurate. It is offered as a practice suggestion and is not a substitute for instruction from a qualified teacher. Directors should review AI-generated lesson material before using it.
All AI features are optional. A director may disable any of them, or all of them, from the Teacher Dashboard at any time; the setting is enforced on our servers and takes effect immediately for the whole program. No part of the service other than the AI features themselves depends on them, and disabling them does not change your subscription or its price. Disabling is prospective — it does not delete AI responses already stored against past practice entries, which we will remove on request.
We aim to keep the service available and will give notice of planned maintenance where we can, but we do not currently offer a contractual uptime guarantee. If your district requires one, contact us before purchasing.
To the extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from use of the service. Nothing here limits liability that cannot lawfully be limited.
We may update these terms. Material changes will be posted here and, for schools under contract, notified in advance as that agreement requires.
